Brooklyn, New York — Uriel Criminal Defense P.C., led by Jacob Uriel, Esq., announces that the Appellate Term for the 2nd, 11th, and 13th Judicial Districts has affirmed the dismissal of all criminal charges against Seanpaul Reyes in People v. Reyes (Appellate Term Docket No. 2024-408 K CR).
Mr. Reyes, widely known online as “Long Island Audit,” is a popular YouTube content creator with more than one million subscribers, where he reports on public accountability and government transparency.
In the Criminal Court, Kings County, Jacob Uriel secured a complete dismissal of the accusatory instrument on facial sufficiency grounds. The Kings County District Attorney appealed that ruling.
On February 27, 2026, the Appellate Term affirmed the dismissal of the charge of Obstructing Governmental Administration in the Second Degree, holding that the accusatory instrument failed to allege legally sufficient facts. The prosecution did not challenge the dismissal of Criminal Trespass in the Third Degree. As a result, all criminal charges originally brought against Mr. Reyes remain dismissed.
The Appellate Term modified the order only with respect to the non-criminal violation of Trespass (Penal Law § 140.05), concluding that the pleading was facially sufficient at that stage and remitting the matter to the Criminal Court for further proceedings limited to that violation.
“The Criminal Court and the Appellate Term made clear what should never have been in doubt: you cannot charge someone with a crime without laying out specific facts that actually support it,” said Jacob Uriel, Esq. “Criminal accusations require a real factual basis at the outset. When that standard is not met, dismissal is required. Both courts enforced that basic rule here.”
Uriel Criminal Defense P.C. is evaluating all available appellate options with respect to the remaining non-criminal violation and will continue to pursue all appropriate remedies on behalf of Mr. Reyes.
